CANON PHOTOGRAPHY IN THE PARKS PHOTO CONTEST
1. NO PURCHASE NECESSARY TO ENTER OR WIN.
“Canon Photography in the Parks” Photo Contest Voter Sweepstakes is open to legal U.S. residents within the 50 United States and the District of Columbia, thirteen (13) years of age or older with Internet access and a valid e-mail address at time of entry. But, residents of Maine must be 18 years or older at time of entry. Employees, officers, and directors (including immediate family members and members of their same household) of American Park Network, ION Marketing LLC, Canon U.S.A., Inc. and each of their parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes and/or the “Canon Photography in the Parks” Photo Contest are not eligible to participate The Sweepstakes is subject to all applicable federal, state, local laws, and regulations. Void where prohibited or restricted by law.
2. How to Enter:
The Sweepstakes begins on or about 12:00 AM (midnight) ET on 10/27/09 and ends at 11:59 PM ET on 11/23/09 (“Entry Period”). Sponsor’s computer is the official clock for the Sweepstakes. You may only enter the Sweepstakes online. No other method of entry will be accepted.
During the Entry Period go to: www.usa.canon.com/parks. From among the twenty (20) posted photographs (which were created by finalists in the “Canon Photography in the Parks” Photo Contest, a separate promotion with its own prizing); ten (10) photographs from finalists ages 13-17 (teen), ten (10) photographs from finalists ages 18 and over (adult), vote for your favorite photograph in each age group by checking the box below the photo. Then, complete the online entry form for the Sweepstakes. To complete the entry form, include your complete name, year of birth, address, city, state and zip code, day and evening telephone numbers, and e-mail address. Click “submit” to send your vote and completed entry form. Entrants must complete all data requested on the (online) entry form. If you are a minor in your jurisdiction of residence (generally, under 18), you are advised to obtain the permission of your parent or legal guardian before entering Sweepstakes.
Limit one (1) entry/vote per e-mail address. IF THE SAME E-MAIL ADDRESS IS USED TO SUBMIT MORE THAN ONE VOTE/ENTRY, ALL ENTRIES/VOTES FROM SUCH E-MAIL ADDRESS WILL BE DISQUALIFIED. Use of automated/programmed/robotic means of entry/voting is prohibited.
Entries must be received by 11:59 PM ET on 11/23/09. Incomplete and/or invalid entries are void.
When you enter the Sweepstakes, you may be asked to consent to receive promotional e-mails and reminders for upcoming promotions and information from Canon U.S.A., Inc. Consenting to receive such e-mails is optional and does not have to be agreed to in order to be eligible to enter the Sweepstakes and does not improve your chances of winning. In the event you do consent to receive these e-mails, the use of such e-mail address shall be subject to the privacy statement on the Canon U.S.A., Inc. website.
3. Drawing:
On or about 12/15/09, a random drawing will be conducted from all eligible entries received. The drawing will be conducted by ION Marketing LLC, an independent judging organization, whose decisions are final and binding on all matters relating to this Sweepstakes. The participant whose entry is selected in the drawing will be deemed the potential “Winner” of the Grand Prize (as defined in the Prizing section). Odds of winning depend on the total number of eligible entries received.
4. Prizing:
One (1) Sweepstakes Prize Winner will be selected. The Grand Prize is a Canon EOS Rebel T1i/EF-S 18-55mm IS kit (Approximate Retail Value is $899.99). Prize is awarded subject only to the warranties and guarantees contained in the warranty booklet accompanying the Canon USA product.
Prize is non-transferable and non-assignable, with no cash redemptions or substitutions except at Sponsor’s sole discretion due to prize unavailability for any reason and only then for prize of equal value.
5. Notification:
Winner will be notified by phone, e-mail or mail by ION Marketing LLC. If winner is a minor, Sponsor reserves the right, in its sole discretion, to award the prize in the name of or to the winner’s parent or legal guardian. In the event that the Winner (or his/her parent or legal guardian, as applicable) does not respond to any such notification within three (3) days, disqualification will result and an alternate Winner shall be selected from among all remaining eligible entries received. The Winner (or, if a minor, his/her parent or legal guardian) will receive Sponsor’s Affidavit of Eligibility and Release of Liability/Publicity which must be completed, signed before a notary public and returned within ten (10) days of receipt. Disqualification will result and an alternate Winner will be selected if Sponsor’s Affidavit of Eligibility and Release of Liability/Publicity are not returned within the specified period of time. Refusal or return of Sponsor’s Affidavit of Eligibility and Release of Liability/Publicity as non-deliverable will also result in disqualification and cause an alternate Winner to be selected. By participating in this Sweepstakes and submitting an entry, all entrants (if a minor, his/her parent or legal guardian) agree to be bound by these Official Rules and the decisions of the judges. By entering the Sweepstakes, the Winner (if a minor, his/her parent or legal guardian) agrees to waive any and all claims against Sponsor, American Park Network, ION Marketing LLC, their affiliates, employees, agents, and representatives for personal injury, property damage or other loss of any kind that may occur from participation in the Sweepstakes or from the receipt or use of the Prize.
6. General Conditions:
Canon U.S.A. Inc., ION Marketing LLC, American Park Network, and their affiliates, employees, agents and representatives are not responsible for printing or typographical errors in any Sweepstakes-related materials; stolen, late or misdirected entries; and/or lost, damaged, garbled, delayed, misdirected, damaged, incomplete or illegible entries (or votes). Canon U.S.A. Inc., ION Marketing LLC, American Park Network, and their affiliates, employees, agents and representatives, and any telephone network or internet service providers are not responsible for incorrect, inaccurate transcription or loss of entry information, or any viruses transmitted to computers of participants via the Internet, or for any technical or human errors associated with the Sweepstakes. If, in Sponsor’s exclusive judgment, this Sweepstakes becomes compromised in any way, Sponsor reserves the right to withdraw the Sweepstakes offer, cancel the (online) method of entry, to void any entries submitted fraudulently and any entries that were affected by the Sweepstakes being so compromised and/or to select Winner from all eligible entries received prior to the act determined to have compromised the Sweepstakes. Notice of such action by Sponsor will be posted on www.usa.canon.com/parks.
Any attempt to deliberately damage the content or operation of this Sweepstakes (including but not limited to any attempt to tamper with or otherwise manipulate voting totals) is unlawful and subject to legal action by Sponsor or its agents. Sponsor shall have the sole right to disqualify any participant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in its sole discretion. All disputes will be resolved under New York law, with the sole exception of choice of law/conflict of law rules of New York or of any other jurisdiction which would result in the application of the law of any jurisdiction other than New York.
In the event of dispute, entry will be deemed to have been submitted by the authorized account holder of the e-mail address at the time of Sweepstakes entry. The authorized account holder is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail address.
Further, by participating in the Sweepstakes, each participant (if a minor, his/her parent or legal guardian) agrees, to the fullest extent permitted by law, to indemnify, release, forever discharge, and hold harmless, and covenant not to sue, Sponsor, American Park Network, ION Marketing LLC, and each of their respective owners, stockholders, directors, officers, employees, agents, representatives, successors, heirs, and assigns, and each and every person acting by, through, under or in concert with them, or any of them (hereinafter referred to as the “Indemnified Parties”) of and from all manner of action or actions, cause or causes of action, at law or in equity, suits, claims, demands, damages, liability, lost cost or expense, of any nature whatsoever, known or unknown, fixed or contingent which the participant (or his/her parent or legal guardian, as applicable) may have or hereafter have against the Indemnified Parties by reason of any damages, loss, or injuries sustained by the participant (and/or his/her parent or legal guardian, as applicable) whether to his/her person and/or property, as a result of or incident to the negligent acts or omissions of the Indemnified Parties in conducting the Sweepstakes and/or of the participant’s participation in the Sweepstakes.
As a condition of entering the Sweepstakes, each participant (if a minor, his/her parent or legal guardian), to the fullest extent permitted by law agrees that: (1) under no circumstances will the participant (or his/her parent or legal guardian, as applicable) be entitled or permitted to obtain awards for, and participant expressly waives all rights to claim, punitive, incidental, and consequential damages, and any other damages, other than actual, out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; (2) any and all disputes, claims, causes of action, and liability arising out of or connected in any way with this Sweepstakes and/or the Prize shall be resolved individually, without resort to any form of class action, and exclusively by arbitration under the rules of the American Arbitration Association and (3) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event shall attorney’s fees be recoverable by either party.

For name of Winner and/or Official Rules, mail a self-addressed stamped envelope to: Canon Photography in the Parks Photo Contest Voter Sweepstakes, Winner’s List and Official Rules (specify which), P.O. Box 5046, Grand Central Station, New York, NY 10163, to be received by 01/15/10.
